PayPal censors e-book publishers

A PayPal spokesperson, in a statement to msnbc.com, said that "in general" PayPal allows its service "to be used for the sale of erotic books, but we have to draw the line on certain adult content that is extremely or potentially illegal."

While the company says it "can't comment on the specifics of the Smashwords account, we can confirm that we are working directly with Mr. Coker to resolve this issue.? Payments to the Smashwords account have not been suspended and Mr. Coker is able to use his account as normal."

Genetic risk for elevated arsenic toxicity discovered

One of the first large-scale genomic studies conducted in a developing country has discovered genetic variants that elevate the risk for skin lesions in people chronically exposed to arsenic. Genetic changes found near the enzyme for metabolizing the chemical into a less toxic form can significantly increase an individual's risk for developing arsenic-related disease.

The discovery could point the way to new screening and intervention options for people who are exposed to groundwater with high levels of arsenic, said scientists at the University of Chicago Medicine, Columbia University, and in Bangladesh in a study published in PLoS Genetics.

"These results add clarity to the genetic architecture that is playing a role in arsenic toxicity and its underlying biology," said senior author Habibul Ahsan, MD, MMedSc, Louis Block Professor of health studies, medicine and human genetics at the University of Chicago Medicine. "It's a rare type of study for a major problem affecting millions of people around the world, and it opens up opportunities for genetic studies of other major public health problems in developing countries."

The group's genome-wide association study, or GWAS, was conducted in nearly 3,000 individuals exposed to arsenic for decades in Bangladesh. Since the widespread installation of hand-pumped wells to tap groundwater sources in the 1970s, as many as 77 million people ? about half the population of Bangladesh ? have been accidentally exposed to dangerous levels of arsenic. The World Health Organization calls the exposure "the largest mass poisoning of a population in history."

For more than a decade, Ahsan and colleagues have studied the epidemiology of arsenic-related disease, such as skin lesions, diabetes, and respiratory illnesses, in this population, as well as the effectiveness of interventions to prevent toxicity. In the new study, funded by the National Institute of Environmental Health Sciences and the National Cancer Institute, the researchers sought genetic answers for why some individuals appear to be at higher risk for developing disease after arsenic exposure.

"Whatever the source of exposure, different individuals vary with respect to their susceptibility to the toxicity of arsenic," Ahsan said. "Even if they consume or are exposed to arsenic at the same dose and duration, some individuals will manifest toxicity phenotypes and others won't."

Researchers genotyped thousands of arsenic-exposed individuals from the group's main studies for single nucleotide polymorphisms (SNPs) throughout the genome, and looked for associations with arsenic metabolite levels and risk of skin lesions.

After ingestion, the body metabolizes inorganic arsenic into first monomethylarsonic acid (MMA) and then dimethylarsinic acid (DMA). MMA is considered to be more toxic, while DMA is water-soluble and more easily excreted. Higher levels of DMA or lower levels of MMA measured from an individual's urine are associated with lower toxicity.

A research team led by Ahsan and Brandon Pierce, PhD, an assistant professor of epidemiology at the University of Chicago Medicine, then used GWAS to search for SNPs associated with DMA and MMA levels. They found several significant genetic variants in the region of a likely candidate gene: arsenite methyltransferase (As3MT), an enzyme critical for arsenic metabolism. A second GWAS looking for SNPs associated with the development of skin lesions after arsenic exposure, pointed to many of the same variants. In a further study of gene expression levels, those same SNPs were associated with reduced expression of the arsenic metabolizing enzyme.

"This makes perfect sense," Ahsan said. "It gives us a very coherent story that we can now investigate in relation to other arsenic pathologies and in relation to a wide range of arsenic doses in this population."

"Now that we understand the molecular basis of some of this disease risk, it is conceivable to now think of incorporating this information into testing, evaluating, or potentially coming up with successful biomedical interventions," Ahsan continued. "By exploiting these metabolic pathways for a subgroup of individuals who will really be at higher risk for getting those diseases, we may be able to reduce fatal outcomes in this population."

The genetic findings provide strong evidence that efficient metabolism of arsenic through methylation protects against the toxin. Compounds that boost methylation, such as folic acid, could reduce arsenic toxicity ? a strategy currently being tested by co-author Mary Gamble, PhD, associate professor of Environmental Health Sciences at Columbia University.

"If we could somehow find a way to do that in Bangladesh, it would make individuals much better methylators of arsenic, and as this current study shows if you're a better methylator you're at a lower risk for disease," said co-author Joseph Graziano, PhD, Professor of Environmental Health Sciences and Director of Superfund Research Program at the Mailman School of Public Health of Columbia University.

Risk variants may also help assess the potential toxicity of cancer chemotherapies which use arsenic or related compounds. SNPs associated with elevated sensitivity to arsenic toxicity could steer oncologists toward lower doses or alternative treatments in certain cancer patients, Ahsan said.

Beyond the clinical applications, the current study demonstrates that large-scale genomic studies are possible in a largely rural population of a developing country. The study offers a rare example of a GWAS result with clear, immediate potential for translational impact.

"Many genomic signals that we see are not robust enough or do not pertain to a large population," Ahsan said. "But in this study, that is not the case. The finding is robust, and the impact is massive."

While most of the programmes funded by the Deutsche Forschungsgemeinschaft (DFG, German Research Foundation) focus on scientific projects, the DFG's "Gertezentren Core Facilities" initiative was developed to improve research frameworks. Many German universities and research institutions have outstanding and often unique scientific instrumentation and research infrastructure. Access to these advanced technologies plays an important role in many branches of science. However, establishing instrumentation centres and networks for shared use often fails due to extensive structuring processes. A call for funding proposals issued by the DFG in March 2011 sought to address this issue by providing support to pilot projects dedicated to professionalising the use and management of infrastructure at suitable facilities.

The initiative, which provides successful projects with funding for a three-year period, attracted more than 120 inquiries and 57 funding proposals, confirming a widespread interest in the development of capacities in this area. In addition to descriptions of their planned activities and measures to strengthen links between instrumentation centres and the scientific community, universities applying for funding were required to show that the DFG's support would also be used to create sustainable infrastructure.

Eleven projects were selected in the multi-tiered review process, and each will receive a total of 450,000 euros over the next three years. The "Good Manufacturing Practice Facility" in Dresden is a centre for cutting-edge technology in the field of regenerative therapy, while the "NeuroImaging Core Facility" in Magdeburg specialises in medical imaging technology for neuro-scientific research. Three other projects are based in the field of optical imaging: "JIMI" a network for intravital microscopy based in Berlin and Jena, the "Biopolis Dresden Imaging Platform", and a nationwide network for microscopy and imaging "German BioImaging" which will be coordinated from Constance and Freiburg.

Another nationwide network, specialising in NMR spectroscopy, is coordinated by researchers in Frankfurt and Munich. The "Quantitative Biology Center Tbingen (QBiC)" combines a range of "omics" technologies with expertise in the field of bioinformatics. In Berlin, the "BioSupraMol" instrumentation centre and competence network specialises in chemical analysis for supramolecular chemistry. Targeted analyses are also the focal point at the "Mnster Isotope Research Center", which has an extensive range of facilities for geoscientific research. The last two projects are in the fields of materials science and structural physics: the "Ernst Ruska-Centre (ER-C)" in Aachen/Jlich, which manages a collection of unique electron-microscopy technologies; and the "Center for Nanoanalysis and Electron Microscopy (CENEM)" in Erlangen, which specialises in nano-characterisation with electrons, x-rays and scanning probe microscopy.

The DFG hopes that the initiative and its funded measures will serve as a signal to universities, providing impetus for enhancing structures with regard to infrastructure resources. The responsibility for implementing these measures will continue to lie with the universities and research institutions. "Universities are rethinking their approaches on how to manage and utilise their instrumentation infrastructure. The response to the DFG's call for funding proposals demonstrates the need for support in this area," emphasised DFG President Matthias Kleiner following the announcement of the funding decision at a session of the DFG's Joint Committee. The DFG now plans to issue another call for funding proposals in this area later this year.

WESTERVILLE, OHIO?Otterbein University will host the 2012 Ohio Athletic Conference (OAC) Indoor Track and Field Championships Friday and Saturday inside the Clements Recreation and Fitness Center.

Events are scheduled to begin at noon Friday and 10 a.m. Saturday. Admission is $7 for adults ($10 for a two-day pass), $5 for senior citizens, and $2 for students not attending an OAC institution. OAC students are admitted free of charge.

School record holders Kristen Bennett and Austin Curbow headline a list of Otterbein student-athletes expected to finish high at the championships.


Bennett, a junior from Wadsworth (Wadsworth High School), ranks first in the OAC in the long jump (18-4 1/4), while Curbow, a senior from Gahanna (Lincoln), holds down the top spot in the 60-meter hurdles (8.01). A two-time indoor All-American, Curbow is a three-time defending OAC champion in the hurdles.

Abbey Gray, a freshman from Waynesfield (Goshen), and Rachel McKeever, a sophomore from Dover, hold the second- and third-fastest times of 9.24 and 9.35, respectively, in the 60-meter hurdles this season.

Distance runner Rebekah Reese, a junior from Columbus (Centennial), sits fourth in the 3000-meter run (10:39.83) and fifth in the mile (5:21.31). Samantha Stolarz, a junior from Circleville, holds down the fourth spot in the 500-meter run (1:22.23).

Rounding out the list of top-ranked women?s performers are Jordan Long, a junior from Newark, and Ayla Starcher, a sophomore from Lewis Center (Olentangy Orange), who share third place in the pole vault (10-6 1/4); and Kristen Norris, a freshman from Westerville (Central), who ranks third in the triple jump (35-7 3/4).

Turning to the men, Andrew Mantell, a sophomore from Hilliard (Bishop Ready), ranks third in the 500 meters (1:07.48), fourth in the 800 meters (1:57.90), and seventh in the 1000-meter run (2:37.84).

Arnez Franklin, a junior from Gahanna (Lincoln), sits fourth in the 400 meters (50.57) and fifth in the 200 meters (22.94).

How Attending a Writer's Conference Can Change the Course of ...

I just returned from speaking at the San Francisco Writer?s Conference for the fourth year in a row, How attending a writer's conference can change the course of your author careerand speaking there is a highlight for me each year. I was an attendee at that event seven years ago and it changed the course of my career in some pretty remarkable ways.

When I showed up for the first time at San Francisco Writer?s Conference back in 2005, I was ready to change the world! I traveled there with a friend, but when we arrived I told her that I?d see her when the conference was over. I wanted to increase my chances of meeting as many people as possible and knew I wouldn?t do that if I was huddled with a friend the whole time.

I attended as many sessions as I could, made a point of introducing myself to people at every opportunity, took copious notes, and soaked up the entire experience. On the last day, we had the opportunity to participate in ?speed dating with agents.? I was pitching a business startup book, which actually helped me stand out amongst attendees who were primarily pitching fiction and memoir.

As a result of those pitches, 14 agents and editors requested that I send them proposals for my book. I returned home and send them out quickly, anxious to hear back and land that book deal.

The rejection letters came in one-by-one, and they had a common theme. The letters pointed out that I didn?t have a platform. Then I received a phone call from Michael Larsen, a successful literary agent and co-founder of the San Francisco Writer?s Conference. He told me that he liked my writing, but that nobody knew who I was. If I wanted to land a book deal with a major publisher, I needed to have an audience. He said that I should be out speaking to thousands of people each year.

That phone call changed my life.

I decided that I would turn to the internet to build an audience. I knew that I wanted to reach entrepreneurs and aspiring entrepreneurs and so I launched BusinessInfoGuide.com and began sharing articles and resources on the site. The truth was that I had no idea what I was doing! But I noticed that the more content I added; the more traffic the site received.

Because I was impatient with the traditional publishing option, I decided to self-publish that first book: The Business Startup Checklist and Planning Guide. I listed it for sale on Business Info Guide a full two months before it was in print and that darn book began selling immediately. That?s when I really understood what Mike Larsen had said. I was building an audience?and that?s what publishers wanted.

When I wrote my next book the following year, I had a high-traffic website and a large e-newsletter list. I wrote a proposal and sent it to exactly two publishers. John Wiley and Sons picked it up and gave me my first book deal for From Entrepreneur to Infopreneur: Make Money with Books, eBooks, and Information Products.

After that, I followed up with one of the literary agents who I had met during the speed dating event at the writer?s conference. We?d had a connection and I knew I was finally ready to get her attention. Because I had a platform, Andrea Hurst signed on to be my agent and landed two more book deals for me. Though I later returned to self-publishing after growing frustrated with the lack of control with traditional publishing, I wouldn?t change a thing about my journey.

Attending the San Francisco Writer?s Conference was a life-changing experience for me that changed the trajectory my author career. It was there that I learned what I needed to know to navigate the world of publishing, and made connections with people that I will maintain for a lifetime. I am honored to return each year as a speaker and as a success story.

If I hadn?t attended that conference, I would have missed out on learning opportunities and the connections that I made there. Who knows how much longer it would have taken me to figure out what I needed to know and make the contacts that would move my author career forward.

I firmly believe that every writer should attend at least one writer?s conference. If you go with an open mind and a willingness to learn, it can make all the difference.

Are you working 11 hours a day? How depressing!

Researchers in Finland studied more than 2,000 white-collar workers over five years. The results were depressing. WBBH's Nick Ciletti reports.

People who worked more than 11 hours a day are more were more than twice as likely to be depressed than their co-workers who put in an 8-hour day.

"There has to be different outlets of enjoyment in a person's life," said Mabel Lopez, a clinical psychologist.

Eating Organic on a Budget | Toddler Times

organic 300x225 Making Room in Your Budget for Eating Organic In a perfect world, we would probably all feed our babies and toddlers all organic and healthy foods to give them the absolute best start in life we possible can. They?d eat organic fruits and vegetables as snacks, drink organic milk, and eat meat and eggs from pastured, organic sources. And of course, they?d eat it happily without a hint of complaining or pickiness.

Right! Wouldn?t that be nice?

Unfortunately, we don?t live in a perfect world, whether it?s picky toddlers, or a limited food budget, sometimes the ideal of healthy eating can seem so far out of reach.

For our family, I know the biggest reason that we aren?t able to eat all organically, all the time, is the cost. It?s no secret the organic food is a little pricier than conventional.

But, I still think that eating organic is really important, especially for for young children, and so we?ve made some changes, and found ways to save money in other areas of our life so that we can have the room we need in our grocery budget to purchase organic food for our family.

We have made a lot of changes in our family?s lifestyle toward more green and natural living over the past four years, and most of those changes have ended up saving us lots of money, maybe not at first, but definitely in the long run, and have made room in our limited budget to be able to buy organic food.

Here are just a few simple examples.

1. Cloth Diapering

We cloth diapered both of our kiddos which has saved us thousands of dollars. Even if you can?t commit to cloth diapering full time (we didn?t), you can still reap the benefits of saving money by using reusable diapers.

2. Making Homemade Cleaning Products

By making our own homemade and non-toxic cleaning products from inexpensive ingredients like vinegar and baking soda, we save ourselves the cost of both conventional brand cleaners, and the more expensive green and non-toxic brand cleaners. And guess what ? our homemade cleaners work just as well, if not better, than their conventional counterparts too!

3. Simplified Personal Care Products

We have switched to using safe and non-toxic personal care products, which can be more expensive, but we have greatly simplified the products we actually use (especially me!), from having bathroom cabinets filled with the next best beauty product or makeup item that didn?t quite work out and just ended up wasting money, to just having a few basic, necessary items. I also make some of our personal care products at home for a fraction of the cost of buying either conventional or green products.

4. Decreasing Disposables

By reusing items all around our house, we have eliminated the need to buy one-use items like paper towels and napkins, disposable cleaning cloths, and more. We like to live by the motto: Use it up, Wear it Out, Make Do, or Do Without ? and that really helps us to evaluate the cost of something before bringing it into our home, and to try to find something that we already have that will work for us.

5. Cooking from Scratch

Buying pre-made food items is expensive. And buying organic versions of pre-made food is even more expensive. Cooking at home, from scratch, using organic ingredients is one of the best ways to save money while still feeding your family healthy and organic food!

Senate confirms Cuban-born judge to 11th Circuit (AP)

WASHINGTON ? The first Cuban-born judge to serve on the Atlanta-based U.S. appellate court was confirmed Wednesday by an overwhelming margin that said much about the way the Senate operates these days.

Despite strong support from both parties, including tea party favorite Sen. Marco Rubio, R-Fla., the Senate had to break a filibuster to confirm U.S. District Judge Adalberto Jose Jordan by a 94-5 vote. The one-time clerk to now-retired Justice Sandra Day O'Connor is the newest member of the 11th U.S. Circuit Court of Appeals.

This week, the nomination was held up by another tea party favorite, Republican Sen. Rand Paul of Kentucky. He filibustered Jordan's nomination while demanding a vote on his proposed amendment ? to an upcoming highway bill ? to cut U.S. economic aid to Egypt pending the release of American pro-democracy workers held in that country.

Rather than grant Paul a vote on his amendment, the Senate voted Monday to force an end to his filibuster. Under Senate rules, a final vote on the nomination could not take place until Wednesday.

However, Paul's delay was only the latest development in a disagreement between the parties over the pace of judicial confirmations.

Jordan's nomination was sent to the full Senate in October by a unanimous vote of the Judiciary Committee. The seat he's filling was declared a judicial emergency by the policymaking body for U.S. Courts: basically meaning the appellate panel has been overwhelmed with court filings.

But none of that sped up the process.

Judiciary Committee Chairman Patrick Leahy, D-Vt., accused Republicans of stalling the nomination for months because of issues unrelated to the judge.

"The stalling, the delays, the obstruction, even the votes against ending the filibuster were all about something else, some collateral issue," Leahy said. "They should not have marred this process and complicated this nomination. They should not have delayed this moment when Cuban-Americans will see one of their own elevated to the second highest court in the land."

Sen. Charles Grassley of Iowa, ranking Republican on the Judiciary Committee, blamed President Barack Obama for the delays. He said the president made an end run around the Senate by announcing recess appointments in January when ? Republicans argued ? the Senate was not in recess.

"We could have confirmed more nominees, had the president indicated that he would respect the practice and precedent on recess appointments," Grassley argued. "He would not give the Senate that assurance, so a number of nominations could not be confirmed."

US, Europe look at fast but risky penalty on Iran

(AP) ? The United States and Europe are considering unprecedented punishment against Iran that could immediately cripple the country's financial lifeline. But it's an extreme option in the banking world that would come with its own costs.

The Obama administration wants Iran evicted from SWIFT, an independent financial clearinghouse that is crucial to the country's overseas oil sales. That would leapfrog the current slow-pressure campaign of sanctions aimed at persuading Iran to drop what the U.S. and its allies contend is a drive toward developing and building nuclear weapons. It also perhaps would buy time for the U.S. to persuade Israel not to launch a pre-emptive military strike on Iran this spring.

The last-resort financial effort suggests the U.S. and Europe are grasping for ways to show immediate results because economic sanctions have so far failed to force Iran back to nuclear talks

But such a penalty could send oil prices soaring when many of the world's economies are still frail. It also could hurt ordinary Iranians and undercut the reputation of SWIFT, a banking hub used by virtually every nation and corporation around the world. The organization's full name is the Society for Worldwide Interbank Financial Telecommunications.

Meanwhile, violence is increasing. Explosions in Bangkok on Tuesday ? Israel's defense minister labeled them an "attempted terrorist attack" ? came the day after Israel accused Iran of trying to kill its diplomats in India and Georgia. Those attacks followed the recent killings of Iranian scientists.

In the financial world, the United States can't order SWIFT to kick Iran out. But it has leverage in that it can punish the Brussels-based organization's board of directors individually, possibly freezing their assets or limiting their travel. Talks are focused now on having Europe make the first move.

Short of total expulsion, Washington and representatives of several European nations are in talks over ways to restrict Iran's use of the banking consortium to collect oil profits.

The Obama administration is divided over whether the possible gain is worth the risk in trying to threaten SWIFT into kicking out a member country, in part because of concern that it would set back the global financial recovery. Iran remains a global financial player despite years of banking sanctions, and blocking it from using the respected transfer system would be a black mark like no other.

More than 40 Iranian banks and institutions use SWIFT to process financial transactions, and losing access to that flow of international funds could badly damage the Islamic republic's economy. It would also probably hurt average Iranians more than the welter of existing banking sanctions already in place since prices for household goods would rise while the value of Iranian currency would drop.

Lawyers for SWIFT are holding meetings in Washington. People familiar with the talks say a compromise is possible in which SWIFT would voluntarily bar or restrict Iranian transfers.

But if SWIFT fails to act on its own, the U.S. expects Europe to require it to terminate services for Iranian banks, one Obama administration official said.

David Cohen, the Treasury Department's undersecretary for terrorism and financial intelligence, delivered that message to European Union officials in Brussels earlier this month, said the official, who was not authorized to speak publicly and thus spoke only on the condition of anonymity.

Mark Dubowitz, a sanctions expert advising the White House on Iran, said the Obama administration is having detailed discussions on the merits and consequences of forcing SWIFT to block Iranian transactions.

Some in the administration also prefer to give time for new sanctions on Iran's Central Bank, officially enforced starting just this month, to take hold before layering on a round of even more draconian penalties.

SWIFT was involved in a separate controversy when it was revealed in 2006 that it had skirted the EU's strict privacy laws after the Sept. 11, 2001, attacks by transferring millions of pieces of personal information from its U.S. offices to American authorities as part of the US Terrorist Finance Tracking Program.

"It is an essential cog in the wheel, if not the wheel itself, in international financial transactions and trade," said David Aufhauser, former general counsel at the Treasury Department who worked with SWIFT to set up that information transfer.

SWIFT handles cross-border payments for more than 10,000 financial institutions and corporations in 210 countries. It lets users exchange financial information securely and reliably, thereby lowering costs and reducing risk. It operates on trust and neutrality ? SWIFT accepts nearly all comers and does not judge the merits of the transactions passing through its secure message system. Its managers generally brush off investigators and enforcement agencies, telling them to take up suspected wrongdoing directly with nations or corporations.

Established in 1973, the essential but little-known hub is overseen by major central banks, including the U.S. Federal Reserve and the European Central Bank.

Lawyers familiar with SWIFT's operations said it could bar processing actions with any Iranian party or third parties representing Iran, though that would open the consortium to complaints of favoritism or political influence. It could permit the processing but quarantine Iranian transactions, or require warnings to those doing business with Iran. Penalties on Iran short of expulsion could allow SWIFT to preserve a greater appearance of neutrality but make business partners think twice, lawyers said.

Proponents of blocking Iran from SWIFT say the financial network's own bylaws require that its services not be used to facilitate illegal activities and allow it to prohibit users that are subject to sanctions.

While the U.S. and Europe debate options, some American lawmakers are trying to increase pressure on SWIFT. The Senate Banking Committee passed a measure earlier this month directing the White House to press SWIFT to block Iranian entities.

Rep. Ileana Ros-Lehtinen, chairwoman of the House Foreign Affairs Committee, also introduced a tougher bill that would compel the administration to sanction SWIFT unless it stopped providing services to Iran.

If lawmakers were to pass a compromise bill, final legislation could land on the president's desk in late spring or early summer, according to a senior Senate aide.

The pending legislation has caught the attention of officials at SWIFT. The financial network's general counsel and other advisers requested a meeting with congressional lawmakers and staff, the aide said.

Those meetings are scheduled in Washington for the week of Feb. 20, said the aide, who also spoke only on condition of anonymity.

Officials close to the White House say the Obama administration is comfortable with the less restrictive language in the Senate Banking Committee measure, but has concerns that more-binding legislation would leave the U.S. less flexibility in dealing with Iran.

SWIFT did not respond to requests for comment. In a brief statement posted on its website, the consortium said it is committed to fighting misuse of the financial system to finance terrorism and has cooperated with enforcement agencies in the U.S. and Europe.

Without addressing the specifics of a full expulsion or more limited block on Iranian transactions, SWIFT's statement urged caution.

"SWIFT remains committed to maintaining its role as a neutral global financial communications network" while complying with sanctions laws, the statement said.

But in the past few weeks, there has been none of that, because AT&T Inc. put a virtual wheel clamp on his phone. Web pages wouldn't load and maps wouldn't render. Forget about YouTube videos ? Trang's data speeds were reduced to dial-up levels.

"It basically makes my phone useless," said Trang, an Orange County, Calif. property manager.

The reason: AT&T considers Trang to be among the top 5 percent of the heaviest cellular data users in his area. Under a new policy, AT&T has started cutting their data speeds as part of an attempt to manage data usage on its network.

So last month, AT&T "throttled" Trang's iPhone, slowing downloads by roughly 99 percent. That means a Web page that would normally take a second to load instead took almost two minutes.

AT&T has some 17 million customers with "unlimited data" plans that can be subject to throttling, representing just under half of its smartphone users. It stopped signing up new customers for those plans in 2010, and warned last year that it would start slowing speeds for people who consume the most data.

What's surprising people like Trang is how little data use it takes to reach that level ? sometimes less than AT&T gives people on its "limited" plans.

Trang's iPhone was throttled just two weeks into his billing cycle, after he'd consumed 2.3 gigabytes of data. He pays $30 per month for "unlimited" data. Meanwhile, Dallas-based AT&T now sells a limited, or "tiered," plan that provides 3 gigabytes of data for the same price.

Users report that if they call the company to ask or complain about the throttling, AT&T customer support representatives suggest they switch to the limited plan.

"They're coaxing you toward the tiered plan," said Gregory Tallman in Hopatcong, N.J. He hasn't had his iPhone 4S throttled yet, but he's gotten text-messages from AT&T, warning that he's approaching the limit. This came after he had used just 1.5 gigabytes of data in that billing cycle.

John Cozen, a Web and mobile applications designer in San Diego, hasn't been throttled yet either, but he's been so disturbed by a warning that he's "almost scared to use the phone," he said. Complaining to AT&T got him nowhere, and now he's looking to switch to another carrier.

"I don't think two to three gigabytes is an exorbitant amount," he said. "Really, I'm just looking at pictures and text once in a while."

AT&T spokesman Mark Siegel said that as of last summer, the top 5 percent of data users were using 2 gigabytes of data per month. But he also said the company doesn't actually throttle all of the top 5 percent "unlimited" data users. Last month, the figure was only 0.5 percent, or about 200,000 people, he said.

That's because AT&T only throttles users in areas where the wireless network is congested that month, Siegel said.

Siegel also pointed out that aside from moving to a tiered plan, "unlimited" plan users on the cusp of being throttled can use one of AT&T's 30,000 Wi-Fi hotspots, where usage is unmetered.

The unlimited plan worked fine for AT&T a few years ago, when the iPhone was new. The company had ample capacity on its network, and wanted to lure customers with the peace of mind offered by unlimited plans. Now, a majority of AT&T subscribers on contract-based plans have smartphones, and the proportion is growing every month. That's putting a big load on AT&T's network.

The limited data plans force subscribers to keep an eye on their usage, so they don't overwhelm AT&T's network. Verizon Wireless has adopted similar plans. But the two companies differ in how they manage their remaining "unlimited" subscribers.

Verizon doesn't slow down the "5 percent" unless the cell tower their phone is connected to is congested at that moment, and it slows them down by the minimum amount necessary. By contrast, once AT&T has decided to throttle your phone, it will be slow for the rest of the billing cycle, even if it's 3 a.m. and there are no other cell phones competing for the capacity of that particular cell tower.

Verizon's measures have drawn few complaints, and indeed, may have gone unnoticed even by the "5 percent."

T-Mobile USA is up front about the level it starts throttling at: 5 gigabytes. AT&T subscribers have no idea if they might be among the top 5 percent until they get the warning, which is soon followed by throttled service. While Trang was throttled at 2.3 gigabytes, he knows other iPhone owners who are using 5 or 6 gigabytes per month with impunity.

"It seems very random," Trang said.

Sprint Nextel Corp. is hanging on to unlimited data plans without throttling, alone among the "Big Four" national wireless carriers.

Tallman sees few prospects for a lawsuit against AT&T. The company is still providing unlimited data usage to throttled customers, even if the speeds are so low as to make the phone useless for anything but phone calls and text messages. The company made no promises that "unlimited" data would always be coupled with high speeds, he notes.

"They just guaranteed the highway. They didn't guarantee the speed limit," he said.
