Jury to hear No Doubt's claims against game maker

LOS ANGELES (AP) ? No Doubt's attorneys can argue to a jury that the band was misled by gaming giant Activision Publishing Inc. about how its likeness would be used in the video game "Band Hero," a judge ruled Tuesday.
The ruling by Superior Court Judge Ramona See rejected a motion by Activision's lawyers to dismiss several claims from the case, including fraud, violation of publicity rights and breach of contract. See determined there were genuine disputes about evidence that a jury should consider.
No Doubt sued the Santa Monica, Calif.-based video game company in November 2009, claiming the band was never told that players would be able to unlock avatars of the band to perform other artists' music.
The case cited instances in which players could use singer Gwen Stefani to perform suggestive lyrics from the Rolling Stones' hit "Honky Tonk Women," or have a virtual version of bassist Tony Kanal sing his band's hit "Just a Girl," but with Stefani's voice.
The lawsuit claimed the feature turns the band "into a virtual karaoke circus act."
See denied on a technical basis a request for an injunction barring Activision from using band members' likenesses to perform other artists' work, although No Doubt could still pursue such an order if it wins at trial.
Activision has claimed the idea of "unlocking" unadvertised features of a video game has been around since the early days of the industry and the company did nothing wrong.
Attorneys expect the case will go to trial later this year.
Jeffery McFarland, who represents Activision, said the company has a strong defense and is looking forward to presenting it during trial. During the hearing, he said the company had a video recording of the band being told about the game's unlockable features.
The band's attorney Bert Deixler said the ruling "seemed inevitable" and noted No Doubt has repeatedly won the right to pursue the case, in both state and appellate courts.

There was a time, not long ago, that if you walked by Jenny Stout?s office more than once in a day, you might have noticed that something had changed: her outfit. It wasn?t unusual for this North Carolina stockbroker to jump into her Lexus, drive over to the town square and buy something new -- simply because she was bored with what she was wearing.
But today, you?re much more likely to find "Miss Jenny" wearing a pair of shorts and a green shirt that she picked up at Goodwill. She has lots of green shirts. Green is her favorite color. But it has nothing to do with the color of the money she once managed.
"When you see me, I want you to think of pickles," Jenny laughed. "I want everyone to be thinking about pickles. I?m pretty sure not long from now, Beyonce will be changing the lyrics of her song from ?All the Single Ladies? to ?All the Pickle Ladies!?"
Jenny Stout and her former assistant Ashlee Furr have left the market and gone out into the garden -- in an attempt to prove that money really does grow on trees. Well, not exactly on trees, but on a half-acre of land next door to Jenny?s childhood home, where they?re planting the seeds to become the next big thing in pickles. It?s a far cry from the future they once bet on, but one that grew out of necessity.
"I was on vacation," Jenny remembered, "and Ashlee called to say she?d been laid off. It was the fall of 2009 and the stock market was volatile. I could see the writing on the wall; I spent the next two days in bed crying. I just knew they were going to close down our office and it wouldn?t be long before I was gone, too."
But Jenny Stout is not one to drown in her sorrows. Raised by her grandmother, whom she refers to as MawMaw, Jenny grew up on free school lunches and dinners that often came from her grandmother?s garden. She was the first in her family to graduate from high school and worked her way up from being a secretary to managing $40 million dollars of other people?s money. So it didn?t take long for this self-made woman to choose her next step.
"My husband Bo and I were out on the front porch, where we solve the world?s problems, and he said, 'You make great pickles and you?ve got some land out at MawMaw?s, you should just start a pickle company.? And I knew right then that, with my grandmother?s recipe, Ashlee and I could be America?s First Ladies of Pickles."
Jenny was going back to her roots -- and taking Ashlee with her.
"I?d never picked a cucumber in my life!" Ashlee said with a grin. "I grew up in the heart of Atlanta. There were no gardens or fields anywhere. But when Jenny called, I was in her kitchen the next morning!"
But all the enthusiasm in the world couldn?t have prepared Ashlee for what would come next: "Jenny wanted to take me out to a cucumber farm so I could see how they grow. So I put on a little brown ruffled shirt, a white skirt and flip-flops. I thought I was looking pretty cute until Jenny drove up and burst out laughing. She said 'Didn?t you hear me when I said we were going to the farm?' Well, I didn?t know we?d be walking through the fields!"
Jenny wasn?t the only one laughing. The farmers in their community were as well, but not at Ashlee?s wardrobe. They couldn?t imagine how two women who had never grown anything but money were going to harvest a crop.
"One guy told us he was going to come up with an umbrella and a 12-pack and watch us pick cucumbers," Jenny recalled. "He said, 'That?s going to be a sight -- these two girls, stockbrokers -- thinking they?re really going to do this.'"
But do this they did. The two women kicked off their heels, got down on their hands and knees and planted enough seeds to grow 3,500 pounds of cucumbers. They spent three days in "pickle school" at North Carolina State University, where they learned everything they needed to know about canning and preserving. And not long after they returned, they were reaping the benefits of their investment -- a half-acre filled with five-inch long cucumbers.
"We?d cart them over to my church and prepare the pickles in its commercial kitchen," Jenny said. "You couldn?t walk into the chapel and not smell the vinegar. Then we?d take them over to Smitty?s, our local bar and grill, and ask people to taste them and tell us what they thought."
It wasn?t long before Jenny and Ashley had perfected three pickle varieties: the perfect salt-and-pepper, a traditional bread-and-butter version and a pickle with a little kick -- a jalapeno salt-and-pepper. Now all they needed was the perfect name.
"We wanted to name the company after my grandmother," Jenny sighed, "but we found out that a wafer company already had the trademark. So I called the owner -- since our products are so different-- and asked if she?d mind if we used the name for our pickles. She didn?t just say no, she said, 'Hell, no! We?re in Williams ?Sonoma!' So I said, 'Well, we?ll see you there!' We went ahead and named the company Miss Jenny?s Pickles, and that day, we made it our mission to be right there on those same shelves."
With that matter settled, the pickle ladies were ready to start selling and they weren?t starting small. Well, Jenny wasn?t. She?d set her sights on the Fancy Food Show in New York -- the largest specialty food and beverage event in North America. But Ashlee wasn?t so sure. She thought maybe they were biting off more than they could chew. It would be the first of many times the former stockbroker and assistant had to figure out how to work as partners.
"We both wanted Miss Jenny?s Pickles to be a household name," Jenny said. "There?s no question about that. But we realized at that moment that we had different ideas of what that meant. Ashlee wanted to be in every home in the South and I wanted to be in every refrigerator on earth. And my vision required us to get moving."
It wasn?t long before Jenny convinced her partner that the two of them could take on the world and that they were on their way to the big city. And there, amid the million-dollar displays, they set up a four-foot table and offered up Miss Jenny?s pickles to buyers from the most important grocery and gourmet stores in the country.
"We walked out with hundreds of business cards," Jenny said with delight, "including Whole Foods and Dean and Deluca!"
"Jenny stayed for the whole show, but I flew home early," Ashlee added. "I?d seen enough. I knew one of us better get back home and start making pickles."
That week, the partners began stocking the shelves at their local Harris Teeter stores and calls started pouring in. In fact, their sales multiplied so quickly that they had to begin buying cucumbers from other farmers and partner with a manufacturer to co-pack their pickles.
Now, only two years from the time they planted their first seed, Miss Jenny?s Pickles has already extended its line of products. The ladies have added an award-winning habanero bread-and-butter recipe and a fried pickle which they recently launched on QVC. By this fall, their items will be in 600 stores throughout the United States and China and just down the aisle from that little wafer company that gave them the big fight -- at Williams-Sonoma.
"Growing up, MawMaw always told me to stick in there and good things will happen," Jenny said, reaching for her friend?s hand. "I just know she?s watching over us and grinning from ear to ear.
"That, and telling all her friends, 'You know, my pickles have made it all the way to China!'"

WASHINGTON (AP) ? President Barack Obama paid tribute Monday to the men and women who have died defending America, pointing to Vietnam veterans as an under-appreciated and sometimes maligned group of war heroes who remained true to their nation despite an unwelcome homecoming.
"You were sometimes blamed for the misdeeds of a few," Obama said at the Vietnam War Memorial. "You came home and were sometimes denigrated when you should have been celebrated. It was a national shame, a disgrace that should have never happened."
"Even though some Americans turned their backs on you, you never turned your back on America," Obama said.
Marking Memorial Day at both the black granite wall honoring more than 58,000 soldiers who died in the Vietnam War and earlier at Arlington National Cemetery across the Potomac River from the capital, Obama noted that for the first time in nine years, "Americans are not fighting and dying in Iraq," and the nation was winding down its role in the conflict in Afghanistan.
"After a decade under the dark cloud of war, we can see the light of the new day on the horizon," Obama said to an audience gathered at the Arlington amphitheater lined with American flags under a warm, brilliant sun.
In this election year, Obama said the nation must remain committed to providing for the families of fallen soldiers and help returning service members seeking a job, higher education or health care benefits.
"As long as I'm president, we will make sure you and your loved ones will receive the benefits you've earned and the respect you deserve," Obama said. "America will be there for you."
Obama said sending troops into harm's way was "the most wrenching decision that I have to make. And I can promise you I will never do so unless it's absolutely necessary."
As he seeks re-election, Obama has reminded audiences about the end of the war in Iraq and the move to bring all troops home from Afghanistan by 2014. And in a campaign ad released last week, he credits U.S. servicemen who helped in the raid that killed Osama bin Laden.
Republican presidential candidate Mitt Romney, meantime, promised to maintain an American military "with no comparable power anywhere in the world."
The presumptive Republican presidential nominee appeared with Sen. John McCain of Arizona, the GOP's 2008 presidential candidate, before a crowd in San Diego estimated at 5,000 in what was billed as a Memorial Day service, not a campaign event.
But Romney nevertheless drew clear contrasts with Obama. The former Massachusetts governor warned against shrinking America's military in Europe's image and said the nation must have the world's strongest military to win wars and prevent them.
Veterans could play a significant role in the 2012 election. Exit polls in 2008 showed that Obama was supported by about 44 percent of voters who said they served in the military, while 54 percent voted for McCain, a former Navy pilot who was a prisoner of war for more than five years during the Vietnam War.
A poll released Monday by Gallup found that 58 percent of veterans support Romney and 34 percent back Obama. The results were based on a sample of 3,327 veterans who are registered voters and had a margin of error of 2 percentage points.
Several closely watched states in the election have large blocs of military voters. Florida, home to several military installations, has more than 1.6 million veterans, according to the Veterans Administration. Pennsylvania has nearly 1 million veterans, while Virginia and North Carolina each have about 800,000 veterans living in their states.
The president and first lady Michelle Obama started the day with a breakfast at the White House for families who have lost loved ones in combat.

Breast Cancer Leading Cancer Deaths in Barbados | Health & Fitness
Breast cancer continues to be the leading cancer-causing death in Barbadian women.
Acting Minister of Health, Senator Irene Sandiford-Garner, made this disclosure today, during the launch of a week of activities at the Pan American Health Organization (PAHO) to celebrate the 10th anniversary of the Barbados Cancer Society?s Breast Screening Programme next month.
Senator Sandiford-Garner told those gathered that approximately 50 women died from the disease annually. However, she said that because of early detection and good treatment regimes, like those provided by the Breast Screening Programme, the World Health Organization (WHO) had reported that 89 per cent of women diagnosed with breast cancer in Western countries were still alive, five years after their diagnosis.
She added that chronic diseases, including all types of cancers, were the leading causes of mortality globally, representing 63 per cent of all deaths. A new status report from the WHO, the Senator noted, indicated that these diseases were on the rise and were taking a significant toll on the economies of low and middle income countries like Barbados. She added that they were considered the number one killers today ?above HIV, AIDS and Tuberculosis and, therefore, they pose a significant threat to our health economies?.
She said the Ministry of Health remained cognisant of the need to work with non-governmental organisations to advance quality health care for all citizens.
?Our relationship with the Barbados Cancer Society?s Breast Screening Programme has been a satisfying and rewarding one which has redounded to the overall benefit of the citizens of Barbados. I, therefore, take this opportunity to thank them for their vital work and assistance in the efforts to reduce the incidence of cancer mortality in Barbados. Jumpgate Live Wallpaper [Live Wallpaper Review]
I sure love me some quality live wallpapers. I know, I know, they can sometimes slow down sliding between screens and if they're poorly done, they're a huge drain on the battery. That's why I'm keen to use wallpapers by Kittehface Software. Today I bring you another in a line of great live wallpapers, the Jumpgate Live Wallpaper. What could be better than watching our favorite android, Andy Bugdroid, careen through space with a jetpack strapped to his back? It's hilarious!
Still, as hilarious as it might be, it's also really well done. There's nary a screen stutter when I swipe from left to right, and if you purchase the full version of the wallpaper, you unlock the full settings menu, which really lets you customize your experience.
From the settings menu, you can mess around with everything from the camera speed to the flight speed, to even the amount of asteroids barreling down on our fair, green friend. You can also customize the "energy style" (which is the swirly lane of color Bugdroid is flying through) between three choices: monochrome, Google colors, and pixilated. Monochrome and pixilated are dangerously close to being similar, but if you check them back-to-back, you'll quickly notice how much smoother the non-pixilated option is.
If you eschew the Google colors option, you can also change the color of the energy lane using the energy color? option. (Go figure!) It uses three sliders, which is certainly appreciated (and a welcome improvement over that circular color picker Android had going on for a while).
Rounding out the settings menu are options for star brightness and turning the helix on and off. Other than that, you're done. Well, except for the character option. Did I mention you can get rid of Bugdroid and have a spaceship flying on screen instead? Cause you totally can.
Honestly, Jumpgate Live Wallpaper is probably one of the coolest live wallpapers I've seen in a while. Obviously you've got to be an Android diehard to even consider using it, but if you're reading this article, you probably are.

U.S. declines to label China a currency manipulator
WASHINGTON -- The Obama administration may be getting tougher with China on trade, but its approach in dealing with Beijing on the thorny currency issue remains patient diplomacy.
The Treasury Department, in its semiannual report Friday on exchange-rate policies, once again refrained from labeling China a currency manipulator -- an accusation that would embarrass Beijing and trigger negotiations and possibly even lead to U.S. sanctions.
The Treasury report made plain that U.S. officials believe that China?s currency, the yuan, remains ?significantly undervalued.? An artificially cheaper yuan gives Chinese exporters an extra price advantage in selling their goods in the U.S. But Treasury still declined to cite China, saying that the Chinese have made progress in correcting currency and related imbalances and also have assured the U.S. that they would move more quickly to adopt a more flexible, market-based exchange-rate system.
Treasury officials didn?t say how much they think the yuan remains undervalued against the dollar and other major currencies, but their report cited estimates of 3% to 23% from the International Monetary Fund in July 2011.
China has long tightly controlled the yuan?s exchange rate rather than letting it float freely in international currency markets. But since mid-2005, Beijing has allowed the yuan to rise about 30% against the dollar --? and even more when adjusting for inflation.
But so far this year, the yuan?s value hasn?t budged against the dollar. And with China?s economy now cooling -- and uncertainties in Europe making the slowdown all the more dicey -- analysts doubt that Beijing will let its currency strengthen anytime soon.
The Eurozone?s debt troubles have pushed the euro down sharply to near multi-year lows, and given that the Chinese yuan has been pegged to the dollar this year, the fall in the euro means Chinese goods have become more expensive in the important European market.
?The pressure within Beijing coming from the coastal [manufacturing] provinces is very strong right now -- no ?more appreciation,? said ?Gary Clyde Hufbauer, a senior fellow at the Peterson Institute for International Economics.
As in the past, the Treasury?s decision Friday was immediately criticized by some U.S. manufacturing alliances, but other American business groups praised it as a level-headed move that would avert an escalation of trade tensions with Beijing.
Mitt Romney, the likely Republican presidential nominee, has said that he would label China a currency manipulator, although analysts note that Obama also had spoken tough on the China currency issue before he assumed the White House.
In an election year, Obama has stepped up his talk and actions on China?s trade practices. Last week the Commerce Department slapped stiff tariffs on solar panels imported from China. And earlier this year, Obama established a new trade enforcement unit to crack down on violators, specifically naming China as a potential target, as part of an overall strategy to boost domestic manufacturing, exports and jobs.
?The last thing they [the Obama administration] want is to have a good opening by the Republicans to say they?ve been soft on China,? Hufbauer said.

Research published in the Journal of the American Medical Informatics Association shows that doctors who take patient notes by dictating them give lower quality of care to their patients, compared with doctors who take notes via "structured documentation."
Structured documentation is when the notes are taken and separated by section (like "family history" or "present illness"). Dictating is defined as reading information over a phone, which is then transcribed to an electronic record.
"Dictating may be easier for the doctor, but patients need to be careful," study researcher Dr. Jeffrey Linder, M.D., associate professor of medicine at Brigham and Women's Hospital and Harvard Medical School, said in a statement. "Doctors who dictate may not be paying as close attention to information and alerts in the electronic health record that are important for patient health."
The study included 18,569 visits by 7,000 people. People in the study had diabetes and/or coronary artery disease.
Among the 234 doctors who saw these patients, 9 percent of them dictated their notes, 29 percent of them took notes using structured documentation, and 62 percent typed "free-text" notes (where there's just one window to type down information, a la free note-taking).
Thirty days after the visits, the researchers looked at how the patients were cared for with 15 different measures.
They found that care quality was worse for patients whose doctors dictated the notes, particularly in the areas of documenting patient use of tobacco, diabetic eye exams and antiplatelet medication.
Just last year, a study was published in the journal Annals of Internal Medicine showing that 90 percent of people want to know what their doctors wrote in their patient charts, TIME reported.
However, the study also showed that more than half of doctors surveyed wouldn't want to make their notes available for patients to view electronically for one year, according to TIME.

Isiah Thomas: College, NBA coach or G.M. job wanted
Former Pistons great and Raptors/Pacers/Knicks coach and executive Isiah Thomas told Scott Powers of ESPNChicago.com that he would love to continue his career. Thomas was fired last month after three seasons as coach of Florida International.
?I definitely want to be in basketball again whether it be coaching or as a general manager,? Thomas said by phone. ?My gift is basketball. I would love working with the kids. If it?s the right college program, I would consider it. If it?s the right G.M. job or coaching job in the NBA, I would consider it. I love the game. I just want to be in the game.?
As has been well chronicled, Thomas? track record as both a coach and an executive (he also owned the late Continental Basketball Association) is not exactly sterling, and his departure from the Knicks was messy. But he still has a lot of friends around the NBA, and he?s hoping for the best. ?I?m like everyone else, I keep my options open,? Thomas said. ?My mom always said don?t burn any bridges. I followed her advice. It would have to be the right option and right place.?
