Result is costly for taxpayer who chose wrong FedEx service ...

Timely mailing is timely filing. This ?postmark rule? applies to documents sent to the IRS or Tax Court via the U.S. Postal Service, and to certain services provided by IRS-designated private delivery services.

Warning: If you?re going to use a private delivery service, be sure that the IRS has sanctioned that particular service. One taxpayer found out the hard way when a Tax Court petition was dismissed as untimely because the IRS didn?t approve a particular FedEx service. (Scaggs v. Commissioner, T.C. Memo 2012-258, U.S. Tax Court, 2012)

Don?t be late. The IRS mailed a notice of deficiency to the taxpayer on April 8, 2011. The 90th day to file a petition with the Tax Court was, therefore, July 7, 2011. However, the petition was received on July 12, 2011. The taxpayer used FedEx?s Express Saver Third Business Day service.

The IRS asked the court to dismiss the petition as untimely filed. The court agreed, rejecting the taxpayer?s plea to expand the deadline, based on equitable principles of fairness. Court: The result may be harsh, but the taxpayer isn?t out of luck. The taxpayer may pay the tax, file a claim for a refund and, if the IRS denies the claim, sue for a refund in the appropriate federal district court or the U.S. Court of Federal Claims.

Choose right the first time

The IRS allows you to designate private delivery services, such as FedEx, as the exclusive means by which you can prove that your tax returns or other documents were timely filed, even if the recipient never actually receives them. But not every service from FedEx, for example, passes muster. The IRS has approved these services from these providers:

  • DHL Express (DHL): Same Day Service
  • Federal Express (FedEx): Priority Overnight, Standard Overnight, 2Day, International Priority and International First
  • United Parcel Service (UPS): Next Day Air, Next Day Air Saver, 2nd Day Air, 2nd Day Air A.M., World??wide Express Plus and Worldwide Express.

Climate change views swayed by weather

Independent voters shift their views on climate change with the weather, new research suggests.

During cold snaps, Independents tend to be more skeptical of human-caused global warming than they are on unseasonably warm days, which seem to make them believers, according to a study published in the journal Weather, Climate, and Society. Democrats and Republicans stuck to their climate-change beliefs regardless of short-term weather changes.

"Independent voters were less likely to believe that climate change was caused by humans on unseasonably cool days, and more likely to believe that climate change was caused by humans on unseasonably warm days," said study author Lawrence Hamilton, a sociologist at the University of New Hampshire, in a statement.

  1. Science news from NBCNews.com

    1. Winter's big chill means fewer summer bugs

As the bitter cold in the northeastern United States keeps even hardy New Hampshire skiers off the slopes, there?s at least one potential upside to the cold snap: fewer mosquitoes come summer, according to an entomologist riding out the cold in upstate New York.

    2. Brains vs. immunity: Genes hint at tug of war
    3. Study: Fracking wastewater could be too much
    4. Shrinking proton: Particle is smaller than thought

Previous studies have also shown that global warming belief depends on weather.

To see if there was a connection, the team looked 10 random-sample phone surveys conducted by the Granite State Poll between 2010 and 2012, with a total of 5,000 New Hampshire voters. The phone interviews asked respondents to choose between three options: climate change is happening now, caused mainly by humans; climate change is not happening; or it is happening, but mostly due to natural causes. [ The Reality of Climate Change: 10 Myths Busted ]

They then correlated the dates of those phone calls with temperature and precipitation data drawn from the U.S. Historical Climatology Network.?

While Republicans and Democrats stuck to their views, self-identified Independents shifted their views with the weather.

"The shift was dramatic. On the coolest days, belief in human-caused climate change dropped below 40 percent among Independents. On the hottest days, it increased above 70 percent," Hamilton said in a statement.

Though it may be human nature to tie weather to climate change, that isn't scientific. An individual storm or warm front can't be attributed to climate change, because weather patterns happen over short time periods, while climate change is a long-term trend. On average, climate change may bring more extreme weather.

What could be causing my solid stained doors to make cracking noises

This is hard to say really but it could be a number of different things.

If the door was left in a cold or damp place for an extended period of time then the suddent adjustment of being brought into a warm dry house when it was installed will cause it to expand to its new environment. This expansion can sometimes result in the door grabbing on the inside of the door frame or in solid wooden doors can result in friction being built up between wooden pieces while expanding and then suddenly they can release and cause a small crack sound like what you are describing. This is typically a temporary thing and will slowly stop happening over time.

Another possibility is that the door may not have been built very well. In a solid wooden door the wooden pieces are typically held together in much the same way cabinet pieces are held together, with biscuit pieces and glue. A liberal amount of wood glue will exist between two pieces and they are usually clamped together until fully dried. If one or more pieces were not cut square and yet were still clamped together with glue, then there could be significant stress pulling on the glue as the two pieces wouldn't naturally be seated next to each other. Over time this stress can cause the glue to start cracking suddenly and the overally structure of the door may be weaker as a result.

A final possibility is that since solid wooden doors are heavy, if they are not secured properly to the door frame then you could be hearing stress on the hinges, hinge screws or hinge screw holes into the frame. If the door was installed into an existing door frame using standard three hole interior door hinges then it may not be held secure enough.

Robotic Satellite-Refueling Test Resumes on Space Station

An International Space Station experiment testing the ability of robots to repair and refuel orbiting satellites has resumed, after being stalled for a week by a software glitch.

NASA's Robotic Refueling Mission (RRM) resumed operations Tuesday (Jan. 22) after engineers finished analyzing loads and software limits for the space station's Dextre robot, agency officials announced in a Tuesday mission update.

RRM calls for Dextre, which sits at the end of the orbiting lab's huge Canadarm2 robotic arm, to perform simulated refueling and repair tasks on a washing-machine-size platform affixed to the station's exterior. The latest round of RRM experiments started Jan. 14 and was expected to last about 10 days, but a software glitch halted activities after just a day.

The RRM module, which consists of activity boards and tools necessary to demonstrate on-orbit refueling, launched to the station in July 2011 aboard the space shuttle Atlantis, which was making the last flight in the shuttle program's 30-year history.

The experiment's goal is to demonstrate technology that could someday fix and refuel orbiting satellites robotically, thereby extending their lives and potentially saving satellite operators billions of dollars over the long haul. Such work can be challenging, since current satellites were generally not designed to be serviced.

The first RRM experiments began last year, when controllers on the ground used the two-armed Dextre to snip some wires with minimal clearance. The latest round of activities will be more complex and involved, as Dextre will snip more wires, unscrew caps and pump simulated fuel, NASA officials have said.

Manufacturers say demand up after fiscal cliff fight

BOSTON (Reuters) - Top U.S. manufacturers sounded a confident note about their expectations for 2013 on Wednesday as fears of the year-end "fiscal cliff" faded into memory.

Textron Inc , whose Cessna unit is the world's biggest maker of corporate jets, laid out an earnings forecast that would represent growth of about 12 percent, while larger peer United Technologies Corp , which makes Otis elevators, Carrier air conditioners and Sikorsky helicopters among other products, reiterated a projection that its profit would rise about 13 percent.

Executives at each company said demand is recovering after a year-end pause in ordering, when customers worried about a budget standoff that could have triggered large spending cuts and higher taxes in the United States.

"We probably have had more order activity than we're used to seeing at the beginning of January," reflecting orders that had been delayed, Textron Chief Executive Scott Donnelly said on a conference call with analysts. "We'll see a degree of uncertainty in the jet market as Washington works through its fiscal challenges, but we believe demand will solidify as those uncertainties are reduced."

The Providence, Rhode Island-based company, which also makes Bell helicopters and EZ-Go golf carts, said it expects sales of its Cessna corporate jets to pick up this year.

Budget battles continue in Washington even after the White House and Congress averted a possible year-end crisis that economists called the "fiscal cliff" with warnings of another possible recession.

But the current battle seems less daunting to executives in the face of other signs of a recovering economy.

"What we see in the economy in the U.S. is that the rebound in the housing market is really having a pull-through effect on the rest of the economy," said Greg Hayes, chief financial officer of United Tech, in an interview. "Commercial construction is coming back. We saw particular strength in North America and Asia, not as much of a story in Europe, as you can imagine.

The U.S. housing slump set the 2007-2009 recession in motion and a slow recovery in that market has been one important drag on a long, sluggish recovery. Recent government data have shown a pickup in demand, with a report last week showing housing starts surged to a four-year high in December.

'PATH GETS EASIER'

Hartford, Connecticut-based United Tech, which also produces Pratt & Whitney jet engines, also noted that airlines' orders for its spare parts had risen in the quarter, reflecting higher rates of travel.

"The path gets a little easier," said Daniel Holland, an equity analyst at Morningstar, who covers United Tech. "If you look at all the pieces, a housing recovery here and in China, and an improving environment for Otis (elevators) in China, they have decent, positive momentum."

U.S. lawmakers were expected to vote on Wednesday to extend by four months the government's ability to borrow money, effectively suspending rules that allow the nation to borrow no more than $16.4 trillion.

Textron and United Tech also have significant defense businesses, and some investors worry that the United States will continue to scale back spending on weapons, such as United Tech's Black Hawk military helicopters and Textron's heavy armored vehicles.

GROWTH FORECASTS

United Tech stood by its forecast, first issued last month, that called for 2013 earnings to rise about 13 percent to a range of $5.85 to $6.15 per share, with sales up about 12 percent to a range of $64 billion to $65 billion.

Textron issued a 2013 forecast that called for profit to rise by about 12 percent to a range of $2.10 to $2.30 per share, with revenue up about 6 percent to $12.9 billion.

The results came a few days after General Electric Co , the largest U.S. conglomerate, said that it ended 2012 with a record-high order backlog and sounded a confident note on 2013, sending its shares higher on Friday.

The manufacturing sector has been one of the better performers this quarter, with 80 percent of the industrial companies in the Standard & Poor's 500 index <.spx> topping analysts' forecasts. That is better than the 68 percent of companies across the index that have beaten estimates.

United Tech and Textron shares, each of which had risen roughly 15 percent over the past six months, outpacing the broader U.S. market, were little changed in early trading.

United Tech rose 38 cents, less than 1 percent, to $88.85 and Textron gained 2 percent to $27.66. Both trade on the New York Stock Exchange.

Investors will get more news on the sector later this week, when 3M Co and Honeywell International Inc are due to report results.

Sheriff: New Mexico teen planned family shootings

This undated photo provided by Eric Griego shows Nehemiah Griego. Griego is charged with killing five family members, including his father, mother, and three youngest siblings in Albuquerque, N.M. Authorities in New Mexico say Griego had reloaded his guns after the attacks and planned to go to a Wal-Mart and randomly shoot people. Instead, they say he texted a picture of his dead mother to his 12-year-old girlfriend, then spent much of Saturday with her. The two went to the church where his father had been a pastor, and Griego eventually confessed to killing his parents and three younger siblings. (AP Photo/Courtesy of Eric Griego)

(AP) ? The New Mexico teen accused of killing his parents and three siblings is portrayed in charging documents as a boy haunted by homicidal and suicidal thoughts that included fantasies of killing his girlfriend's parents and gunning down random people at a Wal-Mart.

To his family, he was a bright and talented musician who played guitar, drums and bass with a church group. He also was a champion wrestler who dreamed of following his family's long tradition of military service, and a boy who accompanied his pastor father on rescue missions to Mexico.

In a statement issued Tuesday night on behalf of family, the boy's uncle Eric Griego described those traits, and called on the media and the public not to use 15-year-old Nehemiah Griego "as a pawn for ratings or to score political points."

"He is a troubled young man who made a terrible decision that will haunt him and his family forever," the statement said.

It gave no clue as to what might have prompted the alleged assault by the teen, who authorities say confessed to shooting his mother and three younger siblings in their beds early Saturday, then waiting in a bathroom with a military-style semi-automatic rifle to ambush his father upon his return from an overnight shift at a homeless shelter.

"Our family is heartbroken over this senseless tragedy," the statement said. "We have not been able to comprehend what led to this incredibly sad situation. However, we are deeply concerned about the portrayal in some media of Nehemiah as some kind of a monster."

The family noted they had no indication such a tragedy could happen, but said it's clear something went terribly wrong.

"Whether it was a mental breakdown or some deeper undiagnosed psychological issue, we can't be sure yet," the statement said. "What we do know is that none of us, even in our wildest nightmare, could have imagined that he could do something like this."

After killing his parents, younger brother and two sisters at the family's home in a rural area southwest of Albuquerque, Griego planned to randomly shoot people at a Wal-Mart, Bernalillo County Sheriff Dan Houston said Tuesday. The teen also contemplated killing the parents of his 12-year-old girlfriend, Houston said.

Griego loaded guns and ammunition into the family's van, but it was unclear if he ended up going to a Wal-Mart or how seriously he contemplated continuing his rampage, the sheriff said.

The attack happened Saturday, the same day thousands of gun advocates rallied around the country to oppose the gun-control measures proposed by President Barack Obama following the December elementary school massacre in Connecticut.

What authorities know, Houston said, was that Griego texted a picture of his dead mother to his girlfriend, then spent much of Saturday with the girl and her family. That evening, Griego went to the church where his father once worked, and he confessed later that night to killing his parents and three siblings, authorities said.

"We know Nehemiah had been contemplating this for some time," Houston said. Griego apparently had told others of his plans, but whom and when were still under investigation, the sheriff said.

The motive, Houston said, "was purely that he was frustrated with his mother."

"He did not give any further explanation," he said.

The teen waived his right to arraignment in adult criminal court Tuesday on charges of murder and child abuse resulting in death and was ordered held without bond. He was arrested Saturday at his family's home.

The sheriff's office identified the dead as Greg Griego, 51, his wife, Sarah Griego, 40, and three of their children: a 9-year-old boy, Zephania Griego, and daughters Jael Griego, 5, and Angelina Griego, 2.

The teen had no history of mental illness or run-ins with the law, and neither drugs nor alcohol appeared to be a factor, Houston said. The sheriff noted the teen liked violent video games such as "Modern Warfare" and "Grand Theft Auto," but he didn't say whether he believed the games were a factor.

Greg Griego was a gang member-turned pastor who had served at Calvary, one of Albuquerque's largest Christian churches. He had an extensive arrest record from his gang days, but was best known throughout the law enforcement community for his work as a volunteer chaplain.

The church planned a prayer vigil Wednesday night.

"We are doing what we can as a church body to minister to the remaining family members," Calvary Pastor Skip Heitzig said in a statement. "Only the Lord Jesus Christ can heal this type of pain and heartache."

Who the Hell Are Phil Mickelson's Financial Advisers? | The Big ...

This is the third or so in a continuing series of WTH/WTF posts where we look at famous wealthy folks? investing errors, and wonder just WTF is going in their personal finances. Our goal: Learn from other people?s mistakes. Today?s WTF?! celeb is 42 year old golfer Phil Mickelson.

Phil is ?mad as hell about rising tax rates, and he?s not going to take it anymore.? As Forbes (with tongue firmly in cheek) reports:

?To be honest, it?s hard to blame Mickelson ? who has compiled a net worth approaching $180 million by repeatedly striking a tiny white ball until it falls into a hole ? for putting all options on the table, which according to some, include the possibility of prematurely shutting down his career to avoid his rising tax burden. Let?s take a look at what Mickelson is up against in 2013:

For starters, courtesy of President Obama?s re-election and the subsequent fiscal cliff negotiations, Mickelson will experience an increase in his top tax rate on ordinary income from 35% to 39.6%, and an increase in his top rate on long-term capital gains and qualified dividends from 15% to 20%. Clearly, when faced with tax hikes of that magnitude, it stops making economic sense for Mickelson to continue to swing a metal stick up to 70 times a day in exchange for the $48 million he earns on an annual basis.?

Yes, our exploited golfer is seemingly going Galt. And while the above paragraphs are truly hilarious ? Max Abelson has shown it is terribly amusing to mock the oppressed top 0.1% ? I have to wonder who is advising the world?s second?ranked all-time money winning golfer.

But if we can be serious for just a moment ? and ignore the oblviousness of Mickelson?s utter lack of gratitude for his soft lot in life ? this raises actual financial issues worth exploring. What are the legal ? and I mean black-&-white-legal, no shades-of-grey here ? options that people (whether they are means or not) should consider to minimize their taxes and maximize their investing returns?

A short list would have to include:

? Muni bond portfolios that throw off tax-free income;

? Estate planning (including 2nd to die insurance) which functionally eliminates estate taxes;

? Contributions to your favorite charity(s) to reduce gross total taxable income;

? Establishing a Family Foundation to further reduce tax base;

? Maximizing tax deferred accounts ? 401k, profit sharing, KEOGH, defined benefit plan and cash balance plans ? to generate largest legal deductions;

There is nothing especially fancy here.

Of the list above, Family Foundations and Estate Planning primarily matter only to those with a wealth north of $5 million ? but everyone can take advantage of tax-free muni income, tax deductions for charitable donations, and maximizing your retirement accounts.

Again, I want to emphasize that these are all standard, run of the mill planning steps ? legal, accounting and tax planning methods the IRS recognizes and approves of. In other words, they are not the stuff of Wesley Snipe?s accounting firm.

If I were a gambling man, I would bet that Phil sucks it up, and keeps playing golf. His sponsors (including accounting giant KPMG!) pay him $44 million per year. A more cynical type might assume the entire episode was an appeal to the golf playing demographics, who also do not care for increased taxes.

It appears that ordinary tax planning moves are either unknown by our ungrateful golfer, or maybe are being ignored by his advisers. Perhaps this explains Phil?s ire ? he is misdirecting his anger broadly instead of focusing on his crappy advisers ? who seem to be costing him millions.

Which brings us to our my original headline:?Who the Hell are Phil Mickelson?s financial advisers . . . ?

?

Why so angry, Phil?

Henry David Thoreau was a peculiar fellow. After his secluded stint at Walden Pond, his fixation with the natural world only grew. Starting in 1852, his journal turned into a two million-word project documenting seasonal observations around his small Massachusetts township, Concord. Over the next six springs he could be seen racing about town like a madman in an effort to spot and record that year?s first elusive blooms, all the while taking notes.

?Thoreau was sort of crazed, traveling near and far across Concord to find the earliest flowering species, many of which can no longer be found in the area,? said Charles Davis, a professor of organismic and evolutionary biology at Harvard University. ?We don?t ultimately know why he was gathering this data.?

Until relatively recently, many critics dismissed Thoreau?s work as amateurish. Today, however, he is respected not only for his contribution to literature and philosophy but also for his work as a naturalist.

Most recently, his data made their way into the journal PLoS One, where researchers used those early observations to plot 160 years of ecological change. In 2010 and 2012, which saw record-breaking spring temperatures, plants responded accordingly, they found, with dozens of species in the eastern United States flowering at the earliest times in recorded history.

?It was hard not to notice in 2012 that things were different,? Dr. Davis, a co-author on the paper, said. ?For me, one of the telling stories was walking around Cambridge and Boston and seeing the Irises in bloom in late 2011 and early 2012 ? it was totally bizarre.?

For the past several years, Dr. Davis and his co-authors have been working to quantify that bizarreness. Using Thoreau?s early observations as a starting point, they filled in the gaps with data borrowed from other naturalists and researchers. Thoreau, they found, was not the only environmentally inclined thinker to keep careful records of spring blooms. The author and scientist Aldo Leopold did too, and his meticulous observations from 1935 to 1945 in Dane and Sauk counties, Wis., were added to the database.

?These kind of data are precious and rare,? Dr. Davis said. ?We also recognize their flaws, however.?

To minimize possible biases or mistakes in Thoreau and Leopold?s records, the researchers focused only on 32 Concord and 23 Wisconsin flowering species also supported by other botanists? records. For Concord, the researchers found records for 29 years between 1852 and 2012, while data for 47 years were available in Wisconsin from 1935 to 2012.

They calculated the average first flowering date of all the species over time as well as the average flowering date for individual species, then compared those dates with the mean spring temperature at the study sites for each year.

In 2012 in Massachusetts, nearly all of the species displayed significantly earlier flowering times, the found. Fourteen experienced their earliest flowering dates on record, and an additional 13 did so in 2010. Thoreau, for example, noted the highbush blueberry flowering in mid-May, while last year that species flowered in April 1 ? about six weeks earlier. On average, in 2010 and 2012 the Concord flowers bloomed 20 days earlier than they did when Thoreau first wandered the fields.

Likewise, 19 of Wisconsin?s 23 species equaled or surpassed their earliest recorded flowering times during 2012?s record temperatures, on average blossoming 24 days earlier than they did in the 1930s. Leopold?s woodland phlox first bloomed on April 28; last year, it flowered on April 4.

For now, plants seem to be exhibiting a steady, linear response to warming temperatures. For every degree of Fahrenheit the temperature increases, many flowers come out 2.3 days earlier. But while plant phenology, or seasonal events, appears to be keeping pace with changes in climate, Dr. Davis warned against complacency. ?I don?t want to give the impression that this is obviously a good thing in the sense that we don?t ultimately know the consequences of this earlier flowering,? he said.

Frosts may follow deceptively warm weeks, damaging plant growth and impacting fruit and seed development. A warmer spring may bring a hotter, drier summer, causing a drought in which the plant withers. Other organisms like insect and avian pollinators as well as herbivores depend upon flowering plants for their survival, so a mismatch in ecological timing could cause greater reverberations in the ecosystem.

And at some point, Dr. Davis suggests, there will be a timing threshold that flowering plants cannot cross. ?If species don?t receive the proper chilling requirements, then they may not be able to set their flowering for spring,? he said. ?Once that point is met, it?s likely to be a very bad thing for plant species experiencing that problem.?

?These are the kinds of questions we need to drill down on in the future, but for now we don?t have answers,? he said.

State tax-cut plans tempered by caution in 2013

JEFFERSON CITY, Mo. (AP) -- Emboldened by big majorities and eager to lure businesses, Republican legislators and governors across the Midwest and South are planning to pursue hundreds of millions of dollars of tax cuts in the new year.

Oh yeah, they might raise some taxes, too.

In many states, the exuberance to cut taxes during the 2013 legislative session suddenly has been chilled by worry about the potential consequences. Cautious state officials are now talking about the need for "thoughtfulness," warning that they'll "have to see how their numbers work out" and suggesting that tax cuts in one area may need to be offset with increases in another.

The change in tune comes as Republicans struggle to balance a core belief in lower taxes and bold campaign promises against the practical need to pay their governments' bills. Political obstacles are less of a problem. A party that swept into power in many statehouses in the 2010 elections won even bigger majorities in 2012.

The case study for the new mood ? caution mixed with conflicting impulses ? is Kansas. The Republican-dominated state slashed income taxes in 2012, enough to save taxpayers a projected $4.5 billion over six years. Now it's facing a self-inflicted budget gap of roughly $300 million for the fiscal year that starts July 1 and wrestling with whether to cut services or extend a sales tax hike that is scheduled to expire. In neighboring Missouri, Republican supermajorities in the Legislature are under intense pressure to pass their own tax cuts out of fear that businesses and employees will flow across the border.

"We don't live in a vacuum. It is ever more pressing that we are responsive, because other states are being much more aggressive than the state of Missouri is," said incoming Senate President Pro Tem Tom Dempsey. But he added: "This philosophy of, 'OK we'll cut the taxes and people will come' ? it takes a lot more thoughtfulness."

Tax code changes could be on the agenda in more states than usual in 2013 because more legislatures will be dominated by like-minded members. The number of states in which one party controls both chambers will be at its highest mark in decades, and half the state legislatures will have veto-proof majorities.

The Institute on Taxation and Economic Policy, a Washington-based research group that advocates for a tax code that charges more to the wealthy than the poor, predicts that 2013 will be "a watershed year for tax reform." It says 15 states could enact major tax changes, including Republican-led legislatures in Missouri, North Carolina and Oklahoma and Democratic-led states such as California and Oregon.

The American Legislative Exchange Council, a Washington-based group of legislators and corporations that advocates for free-market policies, also expects more than a dozen states to take up tax code changes in 2013.

"Many states are looking at Kansas to replicate parts of what Gov. (Sam) Brownback did," said Jonathan Williams, ALEC's director of tax and fiscal policy.

Kansas is cutting its individual income tax rates ? lowering the top rate to 4.9 percent from 6.45 percent ? effective in 2013 while also increasing the standard deduction for households and exempting the owners of 191,000 businesses from income taxes.

Brownback originally proposed to offset the income tax cuts by eliminating a number of deductions, including those for charitable contributions and home mortgages, and extending a temporary sales tax increase that is due to expire this July. But legislators decided to keep the deductions and Brownback signed the tax cuts into law anyway. He acknowledged in a December interview that Kansas now faces some short-term budget problems, but he insists the tax cuts are worth it.

"Our region has lagged the South and the Southwest on growth." Brownback told the AP. " ...This is our discussion on how we catch up."

In December, Michigan Gov. Rick Snyder signed a law phasing out property taxes on industrial equipment, eventually saving businesses $600 million a year. But it will come at a cost. Local governments will be allowed to levy special taxes to recoup some of the lost revenue. And the state promises to reimburse most of what police, firefighters and other local services would lose.

Lawmakers in other states are expressing greater caution heading into 2013.

Newly elected Indiana Gov. Mike Pence campaigned on a new 10 percent cut to the state's income tax rates. But Pence's fellow Republicans appear apprehensive about the roughly $500 million price tag. House Speaker Brian Bosma has cautioned that any tax cut must be "sustainable." Budget leaders have hedged on whether Pence's proposal has a shot at passing.

"I don't know if we've decided that yet, I think we'll have to see how their numbers work out," said Republican House Ways and Means Chairman Tim Brown.

Republican Louisiana Gov. Bobby Jindal has proposed reworking the tax code. But he, too, wants it to be "revenue neutral," so if rates are cut in one place, an exemption could be eliminated in another.

North Carolina Gov.-elect Pat McCrory, a Republican, wants to reduce income tax rates to the level of surrounding states such as South Carolina and Virginia. But the proposals under discussion would offset that lost revenue with extra sales taxes.

"We're talking about a revenue-neutral stream to government," said North Carolina Sen. Bob Rucho, a Republican. "This, we believe, will put North Carolina on the cutting edge of economies in the country."

Oklahoma Republican Gov. Mary Fallin hopes to win passage of an income tax cut that stalled in the Legislature last year, but said financial uncertainty in Washington may affect what she is able to propose.

In Missouri, the Senate leader said any income tax cut for individuals or businesses will likely need to be offset with other revenue increases or spending cuts. He cited the potential to collect taxes on Internet sales, sell a state-created workers' compensation firm or save money on prison costs through sentencing changes.

"We are going to be addressing the paid-for aspect of the income tax, such that we don't cut funding to public education nor do we cut higher education," Dempsey said.

CES 2013: If you want a really big HD TV, is it time for an 'ultra HD'?

An ultrahigh-definition screen contains four times more pixels than an HD TV. Higher resolution means viewers can sit about a third closer than with regular HD TV ? without losing clarity.

The race to make TVs larger and larger has created a colossal problem for manufacturers: As screens grow, picture quality worsens ? unless the viewer moves farther away from the screen.

' + google_ads[0].line2 + '
' + google_ads[0].line3 + '

'; } else if (google_ads.length > 1) { ad_unit += ''; } } document.getElementById("ad_unit").innerHTML += ad_unit; google_adnum += google_ads.length; return; } var google_adnum = 0; google_ad_client = "pub-6743622525202572"; google_ad_output = 'js'; google_max_num_ads = '1'; google_feedback = "on"; google_ad_type = "text"; google_adtest = "on"; google_image_size = '230x105'; google_skip = '0'; // -->

The issue is playing out in cozy dens and family rooms around the world. To get the full benefit of a large high-definition screen, viewers must move back from their sets. Since the ideal viewing distance is no closer than three times the height of your screen, or about one and a half times the diagonal length, big TVs have literally forced many families' backs against the wall.

This year, TV makers are doing their best to give huge-screen fanatics more breathing room. New "ultrahigh-definition" sets were shown off Monday by companies such as LG and Sharp at the International CES gadget show in Las Vegas, with other makers set to follow suit. Consumers tend to buy a new set every seven years or so, and television manufacturers are hoping the technology will give consumers a reason to upgrade.

With nearly 8.3 million pixels, an ultrahigh definition screen contains four times more pixels than an HD TV. Because of the higher resolution, viewers can sit close ? according to some estimates, as close as the diagonal length of the screen, which is about a third closer than before ? without losing clarity. That could be appealing to big-screen fanatics who live in small spaces.

Ultra-HD sets come as small as LG Electronics Inc.'s latest model, which stretches 55 inches diagonally. And estimated prices are dropping from the tens of thousands to below $10,000, bringing these multi-megapixel TVs well within the spending range of early adopters.

It could be a few years before prices come down enough for the masses to justify buying ultra-HD TVs, especially considering that the U.S. TV buyers spent a record-low average of $364 on flat-screen TVs during the recent holiday shopping season, according to research firm NPD Group.

Hampering sales even further, ultra-HD faces another problem: There's very little content. Since 2004, only about 50 movies have been shot with an ultra-HD camera. They include the James Bond hit "Skyfall" and the Batman sequel, "The Dark Knight Rises." Only a handful of movies shot on film, including "Taxi Driver," have been converted to ultra-HD.

There's also no standard way of getting content to the TV.

Sony Corp.'s 84-inch ultra-HD model, which it unveiled in November, comes with a computer server capable of storing and playing back giant movie files. It's definitely not affordable for most people, however, and the TV unit with the server thrown in has a price tag of $25,000.

Obama sends military one of its own as DOD chief

WASHINGTON (AP) ? President Barack Obama said he was sending the U.S. military "one of its own" Monday as he selected decorated Vietnam combat veteran Chuck Hagel to lead the Pentagon as it scales back spending and winds down a decade of war.

A former Republican senator from Nebraska, Hagel would be the first enlisted military member to become secretary of defense, and Obama called him "the leader our troops deserve."

"In Chuck Hagel our troops see a decorated combat veteran of character and strength," Obama said as he introduced Hagel at a White House news conference. "They see one of their own," who will champion veterans and military families.

An Army infantry sergeant who risked his life to pull his younger brother to safety while both were serving in Vietnam, Hagel would bring to the job a gritty view of war and the independent temperament to express those views.

He is known as a contrarian Republican moderate who was a fierce critic of the Bush administration's war policies and he is likely to support a more rapid withdrawal of U.S. troops from Afghanistan.

Long the frontrunner for the Pentagon job, Hagel, 66, forged a strong personal relationship with Obama in the Senate, including overseas trips they took together. And he carved out a reputation as an independent thinker and blunt speaker.

"In the Senate, I came to admire his courage and his judgment, his willingness to speak his mind, even if it wasn't popular, even if it defied the conventional wisdom," said Obama. "And that's exactly the spirit I want on my national security team, a recognition that when it comes to the defense of our country, we are not Democrats or Republicans, we are Americans."

Hagel has also suggested he won't be shy in disagreeing with the commander-in-chief and his outspoken nature has already given some senators, who will confirm his nomination, pause.

"I do think Obama's done a good job overall. There are a lot of things I don't agree with him on; he knows it," Hagel told the foreign policy website Al-Monitor last March.

Wounded during the Vietnam War, Hagel initially backed the invasion of Iraq, but later became a credible critic of the wars, making routine trips to Iraq and Afghanistan. He opposed President George W. Bush's plan to send an additional 30,000 troops into Iraq ? a move that has been credited with stabilizing the chaotic country ? as "the most dangerous foreign policy blunder in this country since Vietnam, if it's carried out."

While Hagel supported the Afghanistan war resolution, over time he has become more critical of the decade-plus conflict, with its complex nation-building effort.

Often seeing the Afghan war through the lens of his service in Vietnam, Hagel has declared that militaries are "built to fight and win wars, not bind together failing nations." In a radio interview this year, he spoke broadly of the need for greater diplomacy as the appropriate path in Afghanistan, noting that "the American people want out" of the war.

In an October interview with the online Vietnam Magazine, Hagel said he remembers telling himself in 1968 in Vietnam, "If I ever get out of this and I'm ever in a position to influence policy, I will do everything I can to avoid needless, senseless war."

If confirmed by the Senate, Hagel would succeed Defense Secretary Leon Panetta. Panetta has long made it clear he intended to leave the job early this year, after serving in the post for about 18 months.

To political and defense insiders, Obama's preference for Hagel makes sense.

The former senator shares many of the same ideals of Obama's first Pentagon leader, Republican Robert Gates. When Obama became president in 2009, he asked Gates to remain as defense secretary. Both Hagel and Gates talk of the need for global answers to regional conflicts and an emphasis on so-called soft power, including economic and political aid, to bolster weak nations.

"A Hagel nomination signals an interest in, and a commitment to continuing a bipartisan approach to national security," said David Berteau, senior vice president at the Center for Strategic and International Studies.

He said Hagel's two terms in the Senate, before he retired in 2009, spanned the latter years of the post-Cold War military drawdown and the post-Sept. 11 buildup. "From a budget point of view he has seen both ends of the spectrum and that gives him a good perspective to start from."

Hagel's possible selection has been met with mixed reviews. Senate Armed Services Committee chairman, Sen. Carl Levin, D-Mich., said Hagel would be "terrific."

But Republicans have said he faces tough questions, with South Carolina Sen. Lindsey Graham declaring Hagel would be "the most antagonistic secretary of defense towards the state of Israel in our nation's history."

Hagel has criticized discussion of a military strike by either the U.S. or Israel against Iran and spoken of the influence of the "Jewish lobby" on Congress. He also has backed efforts to bring Iran to the table for talks on future peace in Afghanistan.

"The appointment of Chuck Hagel would be a slap in the face for every American who is concerned about the safety of Israel," said Matt Brooks, executive director of the Republican Jewish Coalition.

In comments to the Lincoln (Neb.) Journal Star, Hagel said critics have "completely distorted" his record, insisting he has backed sanctions against Iran and demonstrated total support for Israel.

The National Jewish Democratic Council issued a statement Monday saying it trusts that Hagel "will follow the president's lead of providing unrivaled support for Israel," including "leading the world against Iran's nuclear program."

Hagel often straddled party lines and had some high-profile dustups with his Republican colleagues.

In 2008, he criticized GOP vice presidential candidate Sarah Palin, saying she lacked foreign policy credentials and that it would be "a stretch" to consider her qualified to become president. His wife, Lilibet Hagel, endorsed Obama in his first run for president. Hagel also was mentioned as a possible candidate for Pentagon chief when Obama was first elected.

As defense secretary, Hagel would preside over the withdrawal of combat troops from Afghanistan and the waning days of the war, and would direct some of the steepest cuts in Pentagon spending in years. His task would be to restructure a pared down military that can step away from the grinding wars of the past 11 years and refocus on a swath of regional challenges from Syria, Iran and North Korea to terrorism in Africa and the defense buildup in the Pacific.

His experience and his allies on Capitol Hill will work to his benefit.

"Certainly his name coming forward is one I'm very open to," said Sen. Bob Corker, R-Tenn., who served with Hagel on the Senate Foreign Relations Committee. "I had good relations with him while he was in the Senate. Certainly (he's) a veteran and someone who also spent a lot of time around the world understanding the relations other countries have with the U.S. and vice versa."

Defense analyst Loren Thompson, of the Virginia-based Lexington Institute think tank, said Hagel knows the political system and is known for thinking outside the box, which would help as budget cuts move forward.

"He's a veteran who understands how Congress works and has stayed plugged in to developments in defense policy," Thompson said. "He is not tied to the status quo and will think creatively about how to manage America's military forces."

House approves funding for Sandy insurance claims

Still under pressure to provide federal aid to victims of Superstorm Sandy, the House on Friday voted to increase the borrowing limit for the National Flood Insurance Program, which will pay out 140,000 insurance claims for property damage.

The federal program offers subsidized insurance plans to homeowners who live near the nation's coasts, and it was on track to run out of money by next week if Congress did not act. The payouts in the bill will cost the federal government $9.7 billion.

Local leaders from areas hit hardest by the storm were outraged this week that the congressional vote on the extended funding did not come sooner.

New Jersey Gov. Chris Christie on Thursday lashed out at Congress for failing to act, placing particular blame on House Speaker John Boehner.

"There's only one group to blame for the continued suffering of these innocent victims, the House majority and their speaker, John Boehner," Christie said.

Now the bill has passed the House, the Senate intends to pass the measure on to President Barack Obama using an expedited process that requires no vote.

The funding increase to the insurance program is just the first step in a series of votes related to Sandy. The House plans to vote again later this month on a $51 billion package in relief aid to state governments still rebuilding after the storm.

Weight-loss wager: Lose 120 pounds, gain $6,000

When Rick and Kay Woollen of Tobaccoville, N.C., decided to lose weight last year, they didn?t rely on New Year?s resolutions to get them going. Instead, the couple turned to something stronger than willpower to help them pare the pounds: the promise of cold, hard cash.
